TERMS AND CONDITION

By joining or renewing your membership at the Unionville Badminton Club (hereinafter "UBC"), you are accepting all the terms in this agreement.

 

This Agreement contains all of the terms and conditions applicable to you while participating at our facility. If you do not agree to be bound by the terms and conditions of this Agreement, please do not enroll in the UBC. You must read, accept and sign all of the terms and conditions contained in this User Agreement, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of the UBC.

 

1. Anyone who has health problem should talk with their family physician to determine if they are physically fit to participate in the sport of badminton before entering the court.

2. Members are permitted to bring guests (up to 2 guests per visit) to UBC by playing as drop-in guest member subject to the charge and availabilities of the Gym with the condition that the guests also accept the conditions listed herein, and members will take full responsibility and liability for their guests. Please refer to the Waiver and Release of Liability for detail.

3. All members and guests must check in at the Gym Manager Desk at the playing site/facilities (hereinafter the "Gym") and present valid proof of membership or valid legal identification as may be requested by UBC on each visit to the facilities.

4. All chargeable fees shall be paid prior to given access to the Gym. Proof of membership is required to enjoy member-only price and promotion, unless otherwise specified by UBC.

5. UBC offers members the privilege of advance court assignment, Further more UBC will notify members in case UBC scheduled Gym Day being cancelled.

6. UBC operates within a positive atmosphere of respect and good sportsmanship. Thus all members and guests are expected to exercise proper social etiquette on our premises and to respect the court time allowed for games and to leave your court promptly after the game. For "drop-in" badminton, all participants are also expected to exercise fair play while sharing courts with others.

7. All members and guests attending the UBC must change into appropriate sporting attires and athletic footwear before entering the court. Protective glasses are strongly recommended. NO black or dark-soled shoes or shoes that have been worn outside are allowed on the court.

8. When entering in the Gym, members and guests are expected to behave in a sensible and responsible manner. UBC is not responsible and cannot be held liable for any injury to any individuals, members or guests. Everyone must treat all equipment provided with care and respect and to make sure the court is clean and free of obstruction before exiting the court. UBC reserves the right to deny access and eject from the premises anyone who uses profanity, exhibits disruptive behavior, conducts illegal activity and/or harassment of any form, or violates UBC's terms and condition at the cost of that customer. Any damaged equipment must be replaced by the responsible individual(s).

9. UBC shall not be held responsible for any lost or stolen items in the Gym, or for any loss or damage to participants' vehicles that are parked at the Gym site parking.

10. Children age 10 and under are not permitted to enter UBC unless accompanied by a parent or under the continuous supervision of a coach.

11. UBC Membership is non-transferable and non-refundable. Membership begins immediately on the same day listed as "Starting Date" and shall expire automatically on the same day listed as "Ending Date". Members electing to renew their membership, subject to the UBC new arrangement, can pay to renew their membership for the new Term when it becomes available.

12. UBC may limit your activity, issue a warning, temporary suspend or permanently terminate your membership and refuse to provide our services to you if: (a) you breach this Agreement; (b) we are unable to verify or authenticate any information you provide to us.

13. This Agreement shall be governed in all respects by applicable laws of both federal; provincial jurisdiction and city bylaws and regulations. UBC do not guarantee continuous, uninterrupted or secure access to our services, and operation of UBC may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in effect. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

14. UBC reserves the right to make change or amend this Agreement without prior notice to the members.

15. WAIVER AND RELEASE OF LIABILITY (details refer to the Waiver of Liability and Hold Harmless Agreement)

Note: By joining the event sessions, by default, the participant affirms that he/she has read, fully understand, and agreed with the Waiver of Liability and Hold Harmless Agreement.

Waiver of Liability and Hold Harmless Agreement

 

  1. In consideration for receiving permission to participate in any badminton sports, tournament, games and all other events organized/held by Unionville Badminton Club (hereinafter referred to as the “Activities”), I hereby release, waive, discharge and covenant not to sue Unionville Badminton Club (“UBC”), their officers, agents, servants, or employees (hereinafter referred to as the “Releases”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of the property belonging to me, whether caused by the negligence of the Releases, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.

 

 

  1. I am fully aware of the risks involved and hazards connected with the Activities including but not limited to tournament, games, setting up equipment and I hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activity, whether caused by the negligence of the Releases or otherwise.

 

  1. I further hereby agree to indemnify and hold harmless the Releases from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to my participation in said activity, whether caused by negligence of the Releases or otherwise.

 

  1. I understand that UBC does or may does not maintain any insurance policy covering any circumstance arising from my participation in this event or any activity associated with or facilitating that participation. As such, I am aware that I should review my personal insurance portfolio.

 

 

  1. It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named Releases. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the province of Ontario.
